Who provides the service

TrainPlanner is the trade name of the service provided by Pau Haro Acín, tax ID (NIF) 20857705V, with address at C/ Sant Dídac 41, 1.º C, 46712 Piles (Valencia), España. Contact email for privacy matters: trainplanner@trainplanner.es.

Part 1. The app for students

With the app, students of the clubs and academies that use TrainPlanner book classes, pay their club and follow their activity. You accept these terms when you create your account by ticking the corresponding box; the accepted version is recorded.

Who can have an account

Anyone aged 13 or over. If you are 13, your account needs the approval of your mother, father or legal guardian, who accepts these terms on your behalf. The data you give us must be true and yours; your account is personal and you are responsible for keeping your password safe.

Your relationship with the clubs

Classes, class passes, fees and bookings are offered by each club, which sets its own prices, schedules and rules. When you pay from the app, you pay the club: the charge is processed by Stripe in the club’s own account. Claims about a club’s service, including refunds, are addressed to the club.

Proper use of the app

You may not use the app to impersonate someone else, access other people’s data, disrupt its operation or send unlawful content. If these terms are breached, TrainPlanner may suspend the account.

Deleting your account

You can delete your account whenever you want from the app or from this website. While you owe a club anything, the deletion waits until you settle it, unless you opened the account as a minor. The privacy policy explains what is deleted and what is kept.

Law applicable to the app

This first part is governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence.

Part 2. The service for clubs

A club subscribes to TrainPlanner by signing up on this website, choosing a plan and a payment method, as a business or professional. When signing up it accepts, separately, these terms, the privacy policy and the data processing agreement; the version of each is recorded with the date and the person who accepted it.

Price and payment

The current plans and prices are those published on the pricing page, excluding VAT; 21 % VAT is added to them. Payment is collected in advance through Stripe at the interval of the chosen plan.

Invoices

TrainPlanner issues an invoice for each charge, with VAT shown separately and registered with the Spanish Tax Agency (Verifactu), and leaves it in the club’s panel next to the Stripe payment receipt. To issue it, the club must have its tax details complete.

No minimum term and cancellation

The service has no minimum term: the club can cancel whenever it wants from its panel. Cancelling does not cut the service at once: the club keeps using it until the end of the period already paid, with no refund for the part it does not use.

Refunds

Plan fees, add-ons and the sign-up fee are not refunded. The exception is an amount charged in error or a mistake by TrainPlanner: the amount is then returned through the same payment method and the corresponding corrective invoice is issued.

Non-payment

If a renewal charge fails, the club has 7 days of grace to settle it, during which the service keeps working. If it is still unpaid after those 7 days, the club’s account is frozen: only the «Subscription» section and the download of its data stay open, and nothing is deleted. Once the amount due is paid, the account works again.

Price changes

TrainPlanner gives at least 30 days’ notice of any price increase, by email and in the panel. Until the increase applies, the club can cancel without penalty; otherwise the new price applies from the first renewal after those 30 days.

The club’s student data

The club is the controller of the data of its students, coaches and staff, and TrainPlanner processes it on the club’s behalf under the data processing agreement, which forms part of these terms. If the club registers children under 14, it declares that it has obtained the consent of whoever holds parental responsibility or guardianship.

The club’s communications

The campaigns a club sends from TrainPlanner are sent in its name and under its responsibility as the advertiser, only to its adult members who have consented, with its details and an unsubscribe link in every message.

Proper use of the service

The club uses the service to manage its own activity and may not use it to send unsolicited communications or to process data it has no right to process.

Liability

TrainPlanner provides the service with professional diligence, but does not guarantee that it will always run without interruption. Its total liability to the club, for any cause, is limited to the amount the club paid it in the last 12 months before the event giving rise to it. This limit does not apply in cases of wilful misconduct or gross negligence, nor where the law does not allow liability to be limited.

End of the service

When the club leaves the service, it can export its data. Its data is erased 30 days later, except what the law requires to be kept, as set out in the data processing agreement.

Changes to these terms

Each version carries its date, shown at the top of this page. If these terms change, the new version is published and notice is given before it applies.

Applicable law and jurisdiction

This second part is governed by Spanish law. The club contracts as a business or professional; for any dispute, the parties submit to the courts of the domicile of the holder of TrainPlanner.
